Art. 1519.1. Penalty clauses
A provision in a juridical act that purports to penalize a person for filing an action to
challenge an inter vivos or mortis causa donation, an action related to a succession, or an
action related to a trust administration is unenforceable if, at the time of instituting the action
to challenge, a factual basis existed that would lead a reasonable person to conclude that
there is a substantial likelihood that the challenge would be successful.
