§975. Women's cancer prevention program
A. The office of public health, Louisiana Department of Health, shall provide a
special program of preventive, health, and medical care for women, who otherwise qualify
by law, that concentrates on cancer prevention in women. The program required by this
Section shall include services necessary to prevent or reduce the occurrence of female cancer
by providing minimum mammogram examination and minimum pap smear examination
under the following circumstances, subject to available funding derived from any available
source.
B. In this Section, "minimum mammography examination" means mammographic
examinations, including but not limited to digital breast tomosynthesis, performed no less
frequently than the following schedule provides:
(1) One baseline mammogram for any person who is thirty-five through thirty-nine
years of age.
(2) One mammogram every twenty-four months for any person who is forty through
forty-nine years of age, or more frequently if recommended by her physician.
(3) One mammogram every twelve months for any person who is fifty years of age
or older.
C.(1) In this Section, "minimum mammography examination" means an
examination, including but not limited to digital breast tomosynthesis, performed routinely
according to age requirements as set forth by department regulations, or performed no less
frequently than required by the treating physician.
(2) A healthcare facility may advertise and be recognized as accredited if the facility
has successfully completed the established dose and image criteria, has been accredited for
a three-year period by the American College of Radiology, and maintains current
accreditation. Upon receiving accreditation from the American College of Radiology, the
identifying certificate issued shall be displayed in a prominent place at the facility.
D. In this Section, "digital breast tomosynthesis" means a radiologic procedure that
involves the acquisition of projection images over the stationary breast to produce cross-sectional digital three-dimensional images of the breast.
E. The department shall adopt all regulations deemed necessary in order to effectuate
the provisions of this Section.
