§1141.47. Warranties
A. Except as provided in Subsection G of this Section, the warranty period provided
by law shall apply to this Part.
B. The association may assert a claim to enforce any express or implied warranty
involving the common areas and limited common areas that is either made by the declarant
or could have been asserted by the declarant against a third party in any manner provided by
law.
C. If, during the period of declarant control, the association fails to enforce a claim
that it could have asserted in accordance with Subsection B of this Section, a lot owner who
wishes to assert the claim shall first provide notice to the association by the methods
provided in R.S. 9:1141.38 of the lot owner's intention to do so. The association shall have
thirty days from the date that notice was sent to assert the claim.
D. If the association fails to assert the claim within the thirty-day period, the lot
owner who provided notice may assert the claim of the association to enforce any express
or implied warranty involving the common areas and limited common areas, whether made
by the declarant or a third party.
E. A lot owner's monetary recovery related to a claim asserted in accordance with
this Section shall be limited to the lot owner's damage caused by the breach of warranty
involving the common areas and limited common areas. A lot owner may also seek any
other relief as provided by law.
F. A compromise made by the lot owner asserting a claim in accordance with this
Section or any judgment resulting from the enforcement thereof does not preclude the
assertion of a claim by the association or another lot owner.
G. A claim to enforce an express or implied warranty made by the declarant
involving the common areas and limited common areas in accordance with this Section shall
be asserted within forty days following the expiration of the time period of declarant control
or within the time period otherwise provided by law to assert the claim, whichever period
expires later.
