§99. Reckless operation of a vehicle
A. Reckless operation of a vehicle is the operation of any motor vehicle, aircraft,
vessel, or other means of conveyance in a criminally negligent or reckless manner.
B.(1) Whoever commits the crime of reckless operation of a vehicle shall be fined
not more than two hundred dollars, or imprisoned for not more than ninety days, or both.
(2) On a second or subsequent conviction the offender shall be fined not less than
twenty-five nor more than five hundred dollars, or imprisoned for not less than ten days nor
more than six months, or both.
C.(1) In addition to the penalties imposed pursuant to this Section, upon conviction
of the first offense, the offender shall also be fined an additional five dollars.
(2) In addition to the penalties imposed under this Section, upon conviction of a
second or subsequent offense, the offender shall also be fined an additional ten dollars.
(3) Monies collected pursuant to this Subsection shall be forwarded by the sheriff
to the state treasurer within thirty days of collection.
(4) After allocation to the Bond Security and Redemption Fund as provided in
Article VII, Section 9(B) of the Constitution of Louisiana, the state treasurer shall deposit
the collections into the Louisiana Emergency Response Network Fund as established in R.S.
40:2845.
