§88. Nonperformance of contract by printer; forfeiture of bond
Should the successful bidder refuse or fail to enter into an agreement with the State
of Louisiana, Division of Administration, to serve as state printer of the official journal of
the state after having been notified that its or his bid had been accepted, or should the state
printer of the official journal of the state, after having entered into such an agreement with
the state of Louisiana, Division of Administration, fail to faithfully perform all of the duties
devolving upon said state printer by law or to comply with the terms of the agreement so
entered into, such failure or noncompliance shall, after twenty days' notice in writing sent to
it or him by registered mail, be construed as a breach of the obligations of said state printer
of the official journal of the state, and the proceeds of the bond executed by it or him as
provided in this Chapter shall, in addition to any or all other damages suffered by the State
of Louisiana, Division of Administration, by virtue of any breach of the terms of the
agreement, be due and payable to the State of Louisiana, Division of Administration, as and
for liquidated damages, and shall be collectible without any further demand or putting in
default, provided, however, that the said state printer of the official journal of the state shall
not be deemed to be in default in the event that such failure to comply with its or his
obligation shall be caused by contingencies, happenings or causes beyond its or his control,
including, but not limited to, acts of God, force majeure, fire, flood, war, acts of government,
accidents, inability to obtain material or equipment, or any other acts or events the cause of
which is not attributable to the state printer of the official journal of the state.

§88. Legislative auditor
The legislative auditor shall work with the commissioner of administration to ensure
that each board and commission complies with the provisions of this Chapter.
